2 Conditions of Use
2.1 Acceptance
The conditions described below (hereinafter the “Conditions of Use”) regulate the access of users (hereinafter “User” or “Users”) to the Website at the URLs https://intranet.prosegur.com and https://extranet.prosegur.com (hereinafter “Website”) and the use of the content and services it offers. The Website acts as a content distribution platform and allows access through other Single Sign On (hereinafter SSO *) to other company tools whose conditions of use, if different from the present ones, can be consulted in the respective tool and in the disclaimer section (Legal Notice) of the Website. https://intranet.prosegur.com/Aviso-legal0.

Use of the Website by users implies full acceptance, without reservation, of all of the terms and conditions included in the Conditions of Use that are valid whenever the Website is accessed. As PROSEGUR reserves the right to modify the Conditions of use at any time and without prior warning, the User must read them thoroughly whenever he or she plans to use any of the content or services offered on the Website, as they may have been modified.
2.2 Use
Users commit to using the services and content of the Website in accordance with the provisions of the law and these Conditions of Use, and shall be held accountable by PROSEGUR or third parties for any damage or harm that may be caused as a result of non-compliance with these obligations or unlawful, negligent or fraudulent actions or actions that violate the principle of good faith, generally accepted use or public order.
Use of the Website that is unlawful, damaging to the property, interests or reputation of PROSEGUR or third parties, or that damages, overloads or render useless the networks, servers and other IT equipment (hardware) or IT products and applications (software) of PROSEGUR or third parties remains expressly prohibited.
2.3 Intellectual and industrial content and property
All Website content, including but not limited to the text, photographs, graphics, images, icons, technology, software, links and other audio-visual or sound content, its graphic design and source code, as well as the brands, commercial names or distinctive symbols, is the property of PROSEGUR or third parties. PROSEGUR shall not assign nor grant any licence or authorisation to Users regarding the industrial or intellectual property rights relating to these items.
The aforementioned industrial and intellectual property exploitation rights and, particularly, the reproduction, distribution, public communication and transfer rights may only be exercised in any way by PROSEGUR.
In accordance with applicable legislation, Users are prohibited from performing actions including but not limited to the following:
Reproducing, copying, distributing, making available, publicly communicating, transferring or modifying content, apart from in cases authorised by law or expressly agreed to by PROSEGUR;
Extracting and/or reusing all or a substantial part of the Website content that PROSEGUR makes available to Users.
Duplicating, copying, selling, re-selling or exploiting PROSEGUR Services for commercial purposes, without our prior consent.
Using any registered trademark, logo or other information protected by PROSEGUR copyright without the corresponding prior consent.
2.4 Access
Users may access the Website through the URL address https://intranet.prosegur.com when the equipment or device used is connected to the PROSEGUR internal network, if this is not the case, they may only access through the URL https://extranet.prosegur.com.
When Users do not log in with their employee credentials, that is, their employee code and password, they may only access limited content and services. Once they have logged in, they will access their restricted area in which they can manage their information and access the content and services associated with each User's profile. In addition, users can configure their account to subscribe to certain services and receive alerts on new content that will be free of charge, unless otherwise stated.
The User is responsible for keeping his or her account information and password confidential, undertaking to change the password immediately if they have reason to believe that it is known to a third party.
The User agrees to assume responsibility for all activity performed from his or her account and/or using his or her password.
2.5 Participation policy
Users may participate in the news and in articles published on the Website by creating new content (hereinafter the "Media"). The Media is open for the free, moderate and respectful participation of all Users.
In this regard, decent language is required, and the use of vulgar and/or disrespectful language must be avoided. Likewise, the publication of any text with illegal, obscene, slanderous, threatening and/or xenophobic language, including falsehoods, mockery, curse words, insults or promotional or commercial messages and, in general, any content that may be seen as offensive and/or damaging to the PROSEGUR image, or that of any of the companies in the Prosegur Group, as well as other users or third parties and/or that can represent a violation of their rights, is expressly prohibited.
PROSEGUR reserves the right to periodically review comments and opinions received and, if they are contrary to this participation policy, if they put the reputation of other Users or third parties or PROSEGUR at risk, especially with regards to honour, privacy or self image, slander or false accusations against other Users, third parties or PROSEGUR, or if they disobey public order or appear to constitute a criminal offence, PROSEGUR has the authority to edit and even remove them, with no prior warning to their author, and without this measure being considered censorship or an attack against rights to freedom of expression.
Comments, opinions and information shared must adapt to the topic in question to ensure that the Media is kept organised.
Any information that is owned by a third party or is protected by copyright, or does not have the necessary express authorisation from the author for distribution, cannot be published without due authorisation from the owner.
With regard to any content published on the Website, the User shall declare that he or she has all licences, rights, consent and/or permission required for using and publishing it, and for authorising its reproduction and use by PROSEGUR globally on its Website.
2.6 Liability
For the information and content
PROSEGUR intends for all content on its Website to be of the highest possible quality, but cannot guarantee that it is accurate, thorough or up to date. Access to the Website and use of its information and content is the exclusive responsibility of the Users. PROSEGUR will not be held liable for the consequences, damage or harm that may result from this access or use of the information or content.
For the quality and availability of access
PROSEGUR does not guarantee the absence of viruses, computer worms or other harmful elements. The use of appropriate tools, measures or systems for detecting and removing harmful elements shall be the responsibility of the Users. PROSEGUR shall not be liable for the damage caused to the IT equipment belonging to Users or third parties as a result of accessing the Website.
Access to the Website requires services and supplies provided by third parties without it being the responsibility of PROSEGUR to control their quality, availability, continuity and operation. PROSEGUR shall not be held liable for damage or harm of any kind caused to Users as a result of faults, interruption or suspension of the service for connecting to telecommunication networks while accessing the Website.
PROSEGUR does not guarantee the lack of availability, maintenance and effective operation of the Website and/or its services. Despite this, it shall use its best efforts to ensure that the Website is always accessible and functioning properly.
Of the links
The Website may contain links that enable Users to access other pages or Internet portals (hereinafter "Linked Sites"). In these cases, PROSEGUR acts as an intermediary service provider, and shall only be responsible for the content provided on the Linked Sited insofar as it has effective and clear knowledge of its unlawfulness and has not deactivated the link with due diligence.
In the event that the User considers there to be a Linked Site with unlawful or inappropriate content, they may communicate this to PROSEGUR for an investigation to be conducted as to whether its content is legal or appropriate. Despite this, this communication does not bind PROSEGUR to removing this link.
For participation in the Media
The User shall be fully and exclusively responsible for the opinions, comments, information and content that he or she publishes in the Website Media and shall indemnify PROSEGUR and the companies in its Group for the consequences resulting from this.
Although PROSEGUR shall make all reasonable efforts and display all due diligence in preventing content published by the Users of the Website being contradictory to these Conditions of Use, it shall not be held responsible for the content published by Users beyond not having acted promptly in taking measures to remove the content and restrict its access from the moment at which it has effective knowledge of the unlawfulness of the content hosted, that is, that this content has been declared unlawful by a competent authority or a holder of rights when this content is unlawfully shown.
Likewise, PROSEGUR and the other companies in the Group shall not be responsible for the accuracy of the sources of comments and information communicated by the Users, remaining exempt from any complaint, claim and/or allegation filed by third parties in relation to this.
Damage
PROSEGUR will not assume any liability for damages or losses that could be suffered as a result of events that could not have been foreseen or that were foreseen but unavoidable, either by accident or force majeure.
3. Statistics
To know how the User uses the Website, the Website uses Google Analytics.
This tool uses cookies (to find out more about the cookies, see the Cookies policy).
The information generated by the cookie on the use of the Website (including the User's IP address) is transmitted to Google. This information is used to evaluate the users' use of the Website and to compile statistical reports of the activity on the Web Site.
PROSEGUR will never use or allow third parties to use statistical reports to track or compile any personal data that identify users of the Website. Google will not associate the User's IP address with any other Google data. Neither PROSEGUR nor Google will try to link an IP address with the User's identity.
The User may reject the use of cookies by selecting the appropriate settings in their browser, however, if they do, they may not be able to use the full functional features of this Website.
By using this website, the User accepts that Google will process their information in the form and for the purposes set forth above.
4. Directory
In order to facilitate and streamline communications and professional relationships within PROSEGUR, the "Directory" tool allows Users to see the contact information and photo of their colleagues.
5. Compensation
Users expressly undertake to indemnify PROSEGUR, the companies in its Group, employees, administrators, agents and others affected by the damage or harm (including lawyer and barrister fees and costs) resulting from Users' non-compliance with the Conditions of Use, and they shall, likewise, collaborate with PROSEGUR in defence of its interests in the event that any claim is made or any legal or administrative proceedings are initiated due to this non- compliance. Furthermore, Users undertake to make all reasonable efforts to prevent or, where applicable, minimise the damaging and harmful effects that may originate from this for PROSEGUR.
PROSEGUR shall not be held responsible for (i) the indirect or resultant damage or the (ii) business losses (including loss of profits, income, contracts, predicted savings, data, business fund or any unnecessary costs incurred) that are the direct or indirect consequence of access and use of the Website by the Users.
6. Security warning
Phishing and other fraudulent actions of theft and impersonation of a person consist of third parties posing as employees or simulating an entity's identity through fraudulent use of e-mail to deceive their personal data.
In the relations that the User maintains or intends to maintain with PROSEGUR, the following recommendations must be taken into account:
PROSEGUR shall only make communication via email in the format “talento@prosegur.es”. The User must be wary of any other electronic communications sent to them on behalf of PROSEGUR from a domain other than the one indicated.
In any case, PROSEGUR will never ask the User for their employee credentials (employee code and password) to access the Website, by telephone or by email. In this respect, the User is reminded that these data are strictly confidential, and should only be used for the use/uses to which they are intended. The User is solely responsible for transferring their confidential data to third parties.
Nor will PROSEGUR ask the User for a copy of their national identity document (DNI, NIE, passport), or any data related to their bank accounts or positions by telephone or email. The User should therefore be wary if they do not already and directly know the person requesting this information on behalf of PROSEGUR.
The User must not access the Website through a link, e-mail or website that they do not fully trust. Instead, we recommend directly typing the address into the browser.
In case of doubt about the authenticity of any message or communication received on behalf of PROSEGUR, the User may contact PROSEGUR at the email address comunicación.interna@prosegur.com.
7. Severability
If any clause in the Conditions of Use is declared invalid, void or ineffective for any reason, this condition shall be understood to be excluded, but this shall not affect the validity and enforceability of the remaining conditions.
8. Waiver
In the event that Users do not comply with these Conditions of Use and PROSEGUR does not immediately take the actions and/or enforce the rights at its disposal, this does not imply that PROSEGUR waives the right to make use of them at any other time in the future.
9. Competency and Jurisdiction
The Conditions of Use of this Website shall be governed by English legislation.
The parties expressly waive any other jurisdiction that may correspond to them and formally submit to the Courts and Tribunals of Madrid for any controversy that may arise as a result of the interpretation of, or compliance with, the Conditions of Use governing this Website.
